Where users can send us messages or questions (for example through the contact form), we reserve the right to remove, without notice, any content that breaks the law. Where appropriate, we also reserve the right to take legal action against the user, in particular for racist, abusive, defamatory or pornographic content, in whatever form (text, photographs, etc.).
Nothing in this Legal Notice limits or excludes any liability that cannot be limited or excluded by law, or affects your statutory rights as a consumer.
7. Personal data
We process personal data in line with the UK GDPR, the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations (PECR), as well as the EU GDPR and French data protection law, which apply to us as a business based in France. Full details are set out in our Privacy Policy.
7.1 Who is responsible for your data
The controller of personal data collected when you create an account or browse the website is Victor Neto, legal representative of Nacaba.
As data controller, Victor Neto is committed to complying with the law. Whenever we process personal data, we take all reasonable steps to make sure it is accurate and relevant for the purposes for which we process it.
7.2 Why we collect your data
We may process some or all of the following data:
We never sell your personal data. It is used only where necessary to provide our service, and for statistics and analysis.
7.3 Your rights
Under data protection law, you have the right to:
If we learn that a user has died and we have no instructions from them, we will delete their data, unless we need to keep it for evidence or to meet a legal obligation.
To exercise any of these rights, email contact@nacaba.fr or write to:
Victor Neto 47 rue Vivienne 75002 Paris France
Please tell us which personal data you would like us to correct, update or delete. If we have reasonable doubts about your identity, we may ask you for proof of identity before acting on your request.
Requests to delete data are subject to any legal obligations we have to keep certain records (for example, invoices). You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk, or to the French data protection authority (CNIL) at cnil.fr.
7.4 Sharing and transferring your data
Some of our service providers, including Shopify, may store or process your data outside the United Kingdom and the European Economic Area. Where this happens, we make sure appropriate safeguards are in place, such as adequacy decisions or standard contractual clauses. We remain free to choose our technical and commercial service providers, provided they offer sufficient guarantees under data protection law.
We take all necessary precautions to keep your information secure and to make sure it is not shared with unauthorised people. If we become aware of an incident affecting the integrity or confidentiality of your information, we will let you know as soon as possible and tell you what we have done about it. We do not collect any special category data.
Your personal data may be processed by our service providers (for example, for payment and delivery), only for the purposes set out in this Legal Notice and our Privacy Policy. Within Nacaba, access to your data is limited to the people who handle customer service.
8. Security incidents
No method of sending data over the internet, and no method of electronic storage, is completely secure, so we cannot guarantee absolute security. If we become aware of a security breach, we will notify affected users so they can take appropriate action, in line with our legal obligations.
Your personal information is never published without your knowledge, exchanged, transferred, assigned or sold to third parties. The only exception would be if Nacaba and its rights were acquired by another business, in which case the buyer would be bound by the same obligations towards you.
Security
To keep your personal data secure and confidential, nacaba.fr uses standard protections such as firewalls, pseudonymisation, encryption and passwords. We take all reasonable steps to protect your data against loss, misuse, unauthorised access, disclosure, alteration or destruction.
9. Links, cookies and tags
nacaba.fr contains links to other websites. We cannot check the content of those websites and accept no responsibility for them.
9.1 Cookies
A cookie is a small file sent to your browser and stored on your device (computer, smartphone, etc.). It may contain information such as your domain name, internet service provider, operating system, and the date and time you accessed the site. Cookies cannot damage your device.
Some cookies are strictly necessary for the website to work (for example, to keep items in your basket). These are set without your consent. All other cookies, such as analytics or advertising cookies, are only set if you accept them through our cookie banner. You can change your choices at any time using the cookie settings link on the website, or through your browser settings.
We may use information about your visit, such as the pages you view and searches you make, to improve the website and your browsing.
If you refuse or delete cookies, some parts of the website may not work as well. The same may happen if we or our providers cannot recognise your browser type, language and display settings, or the country you appear to be connecting from. In that case, we cannot be held responsible for any resulting limitations in how the website works.
Each browser handles cookies differently; your browser's help menu explains how to change your settings. We may use external service providers to help us collect and process the information described in this section.
If you click on social media icons on nacaba.fr, those social networks may also set cookies on your device. These cookies are only set if you have given your consent through our cookie banner, and you can withdraw that consent at any time.
9.2 Web tags
We may occasionally use web tags (also known as pixels, clear GIFs or web beacons), sometimes through a web analytics partner who may be located, and store data including your IP address, in another country. These tags are only used where you have accepted the relevant cookies.
Tags may be placed in online adverts that lead to the website and on pages of the website itself. They help us understand how visitors respond to the website and how effective our campaigns are (for example, how many times a page is opened and what information is viewed).
Our external provider may collect information about visitors to our website and other websites through these tags, produce reports on website activity for us, and provide other services relating to use of the website and the internet.
10. Governing law and jurisdiction
Any dispute relating to the use of nacaba.fr is governed by French law, and the courts of Paris have jurisdiction, except where the law provides otherwise. If you are a consumer living in the United Kingdom, this does not deprive you of the protection of the mandatory laws of the part of the UK where you live, and you may also bring proceedings in your local courts.
